REGULAR MEETING:
Ken Metzler called the IWWC meeting to order at 7:35pm.

G. Blessing made a motion to seat Roger Peloquin as an alternate, L. Kouyoumijan seconded the motion.  

New Business

File W2007-11- Application for activity in the upland review area.  Addition of porch on side of house and deck on rear of house at 160 Willington Hill Road (Map 13, lot 29, Zone R80)  Applicant/Owner Edward A D’Agata II.  Received 4/23/07, Hearing or Decision by 6/25/07.

Edward D’Agata was present to discuss the application.  He stated that he would like to add a deck and covered porch to his home.  He stated that he has 26 feet from the back of his house to where the silt fencing begins and the deck would come out 18 feet from the back of his house.  The deck will be 18 feet by 20 feet wide.
The commission looked at the building plans.  G. Blessing asked if the deck would be on piers.  Mr. D’Agata said that it would be.  K. Metzler asked where the roof run off would go.  Mr. D’Agata said that it would go to the gutters.  

G. Blessing made a motion to remain the application to staff.  F. Dirrigl seconded the motion, all members voted in favor.  

File 2007-12-Application for repair of bridge over Fenton Brook, Located in the area of 130 & 96 Tinkerville Road (Map 40) Owner/Applicant Town of Willington.

Karl Acimovic was present to discuss the application.  He passed out plans to the commission and stated that there was a narrative included in the plans.  Mr. Acimovic also passed out pictures of the bridge.  He explained that this is a concrete culvert under a bridge.  Lynn Nichols explained that the head walls are considered historic according to FEMA.  She said that it appears that they were built in the 1950’s.  Ms. Nichols and Mr. Acimovic went over the plan to repair the bridge.  They stated that they are going to leave the metal portions of the bridge in order to create a form to pour the new culvert.  Then they will add timber bracing to the bridge.  

Mr. Acimovic discussed the history of the bridge that caused it to need repair.  He stated that in October of 2005, a sink hole developed and then the storm that occurred this past week created more holes in the culvert creating a major safety issue if left unprepared.  

G. Blessing asked if the repairs would meet storm events.  Mr. Acimovic said that it would.  K. Metzler asked what the long-term integrity of concrete is when it is exposed to the elements.  Mr. Acimovic said it should last 50 to 100 years if it is taken care or.  K. Metzler asked if they would use steal meshing to reinforce the concrete.  Mr. Acimovic said they would use rebar.  G. Blessing asked if the exterior walls need to be braced as well.  Mr. Acimovic said they would not know until they start working.  G. Blessing asked if they would need to pour concrete into the existing walls.  Mr. Acimovic said they would also wait to see once they begin working.  
K. Metzler asked how long this project would take.  Mr. Acimovic said it would most likely take a couple of months.  Weather will be an issue for this project, as they will be working in the water for some of the work.  

R. Peloquin asked when the project would begin; Mr. Acimovic said they would need to wait for FEMA funds to come in first.  They stated that they would need to close the road as well.  

G. Blessing asked if any work would be done in the streambed besides the bracing.  Mr. Acimovic said no.  

Mr. Acimovic stated that the town will be able to do some of the work themselves and he feels they will be able to contract out to local business for most of the other work.  

F. Dirrigl asked what the chances of concrete getting into the river are.  Mr. Acimovic said there is no chance due to the form the concrete is poured into.  

K. Metzler said that he would like to see the plans once they are created and submitted before the commission acts on this application.  

Old Business

Town of Willington, review of storm water maintenance plan and procedures.

Karl Acimovic passed out a progress report for the drainage improvements to the commission members.  He explained that they are working on cleaning out catch basins, plunge pools and outlets on a regular basis.  He stated that they are changing over to a vacuum system to clean out the catch basins from a clamshell method to be more effective.  He stated that work would begin July 1, cleaning out all catch basins in town, then if the fall they will go back and clean out those in high fill areas.   

T. Gutowski asked how many miles of road the town has.  Lynn Nichols said about 70.  She asked if they are using a computer system to find the catch basins.  Ms. Nichols said they are walking the streets and mapping them as they go.  T. Gutowski asked if they are dumping what is taking out of the basins according to state disposal regulations.  Ms. Nichols said that it is dumped in the Ruby Road pit along with the road sweepings.  T. Gutowski asked if they are tested for contaminates.  Mr. Acimovic said that in storm water sediment floats on top.  T. Gutowski said that she is concerned with just dumping the material.  Mr. Acimovic said that they are dumping away from the wetlands.  He stated that if there are volatiles in the waste they will evaporate.  He stated that they are currently looking into another plan for dumping.  The commission discussed prices for testing for hydrocarbons.  
T. Gutowski asked how many catch basins there are in town.  Ms. Nichols said that there are over 900.  She asked if there would be strategic planning for cleaning.  Ms. Nichols said that she is going by GASBY.  T. Gutowski asked how much of GADSBY is finished.  Ms. Nichols said about 40%, as she has to walk each street and measure and map items by hand.

The commission discussed road sweeping, Ms. Nichols stated that it takes three workers to sweep the roads; she needs one person in the sweeper, one in the water truck, and one in the dump truck.  She stated that these take 75% of the public works crew.  T. Gutowski asked if public works is looking at the volume of sand that is being used on the roads in the winter.  Ms. Nichols said that they are looking at what the state did this winter compared to the town.  T. Gutowski said that she was concerned with sediment washing into the wetlands.  The commission discussed the environmental concerns.  

Mr. Acimovic said that he was willing to come to the commission semi-annually to update them on the progress of the storm water maintenance.  

File #W2007-06-Application for Activity within the Regulated Area for the construction of a two car garage located at 22 Old River Road (Map 43, Lot 7). ~Owner/Applicant Michael Anthony Robertino. ~(Received on 2/26/07, Hearing or Decision by 4/23/07). Site walk on 3/24/07.

Mr. Robertino was present to discuss the application.  He submitted and passed out new plans to the commission members.  

G. Blessing said that he did a site walk before the meeting and meet with the applicant.  He said he saw a large amount of flow and was concerned with having a grass swale.  He suggested that the applicant have a gravel swale with two feet of riprap.

G. Blessing made a motion to approve File #W2007-06-Application for Activity within the Regulated Area for the construction of a two car garage located at 22 Old River Road (Map 43, Lot 7). ~Owner/Applicant Michael Anthony Robertino, with the following condition: The swale shall have six inches of rip-rap though out the trench.  R. Peloquin seconded the motion, all members voted in favor of the motion, thus it passes.

File# W2007-03 – Application for Drainage Improvements within regulated area including catch basin at 90 Tinkerville Road (Map 40, Lot 41, Zone R80) Owner: David Hammaker; Applicant: Benny Pagani of Titan General Contractors, LLC. (Received 1/22/07, Public Hearing by 3/26/07; Decision by 4/23/07) ~Site walk on 3/24/07

The commission asked Karl Acimovic if he had seen the new plans for this application. Mr. Acimovic said that he had not.  Mr. Atomic and Lynn Nichols looked at the new plans.  Ms. Nichols said that the town is going to put in a leak off as well as a plunge pool and a swale so the rainwater is able to run off the road.  She stated that currently the Fenton River is above the applicant’s driveway from this weekend’s storm.  She stated that this weekend that water was moving so swiftly that no vehicles or persons could have crossed the driveway leaving the resident with no emergency exit from his home.  

Ms. Nichols stated that the new plans that were submitted meet what she and Mr. Acimovic discussed with the homeowners.  T. Gutowski asked if this would cause sediment lines.  Ms. Nichols said that it would not.  G. Blessing asked if any driveway improvements would still need to be done after the road repairs are made.  Ms. Nichols said there will still be driveway repairs to be done.  

G. Blessing made a motion to approve File# W2007-03 – Application for Drainage Improvements within regulated area including catch basin at 90 Tinkerville Road (Map 40, Lot 41, Zone R80) Owner: David Hammaker; Applicant: Benny Pagani of Titan General Contractors, LLC.  
L. Kouyoumjian seconded the motion.

The town engineer and highway Forman stated that they were satisfied with the plan and noted that the applicant will take care of changes on the east side of the property and the town will make changes to the west side of the property, but noted as well that this will not solve the problem of the bridge flooding.  

All members voted in favor of the motion, thus the motion carries.  

File# W2007-04 – Application for Re-Subdivision of Lot 7 on property at Mihaliak Rd. Ext. and Rosemary Lane (Map 50, Lot 3-7, Zone R80) Owner/Applicant: Mary C. Litwinczyk & Litwinczyk Children, LLC (Received 1/22/07, Public Hearing by 3/26/07; Decision by 4/23/07,Site walk on 3/24/07.)

Joe Miller was present to discuss the application.  He stated that he was filling in for Ed Pelletier who was unable to attend tonight.  He said he did not have information to give the commission; that he was given a new set of plans and explained the changes that were made to the plan.  

G. Blessing said that he did a site walk before the meeting, he stated that there was standing water in the road, but he felt that even if the applicant does nothing to the property water would still collect.  G. Blessing stated that the town might need to look into this issue.  

T. Gutowski asked if the house is now out of the upland review area.  Mr. Miller said it is except for the foundation drain.  
F. Dirrigl asked where the rain gardens would be placed in respect to the placement of the house.  He stated that the details are not labeled on the plan.  F. Dirrigl asked if the town requires anything to be placed at the end of a foundation drain.  Karl Acimovic stated that the end of the drain should be formalized so people don’t forget them and are covered by dirt etc.
F. Dirrigl asked if there is open space for this property.  Mr. Miller said that there was.  

G. Blessing made a motion to approve File# W2007-04 – Application for Re-Subdivision of Lot 7 on property at Mihaliak Rd. Ext. and Rosemary Lane (Map 50, Lot 3-7, Zone R80) Owner/Applicant: Mary C. Litwinczyk & Litwinczyk Children, LLC with the following conditions:
1. The foundation drain and outfall detail be added to the plan
2. The rain garden location is clearly placed on the plan along with a site specific detail.

F. Dirrigl seconded the motion.  All members voted in favor, thus the motion carries.

Review of Operation and Maintenance for Storm Water Systems at Town Library at 7 Ruby Road

G. Blessing told the commission that he looked over the report from the library and wrote a review, but will present it at the next meeting.

Lynn Nichols stated that she was concerned with accessing the detention basin due to its design.  

Cease and Desist Order issued to Joseph Voboril Re: Clover Springs Subdivision Wetlands Permit W2004-04 off Battye Road. Site Walk 11/4/2006 at 9 a.m.

F. Dirrigl told the commission that he did a site walk this past weekend.  He explained to the commission what he saw.  He stated that at the first drainage easement there is a stockpile of stumps either in the wetlands or in the upland review area.  Across from this area, there is another large pile of stumps.  F. Dirrigl stated that along the road that goes through lot 21 there is a large stockpile of stumps.  He stated that when he was there he saw a man with a pick up truck putting up a barrier on this road to keep people from driving on it.  He went on to explain that at the end of the road there appears to be a dumping ground for stumps, logs, tress, and other debris from when the lots were cleared.  

G. Blessing asked who is responsible for cleaning the debris.  The commission discussed if it was the responsibility of the homeowners or Joseph Voboril.  

K. Metzler asked F. Dirrigl if he walked the conservation easement.  F. Dirrigl said that he did not.  He did state that all the silt fencing and hay bails are in bad shape and need to be replaced or the area needs to be regarded so the fencing can be removed.  F. Dirrigl suggested going back to take pictures in order to document.  

G. Blessing suggested speaking with the town attorney to get his input as to what the commissions’ next step should be.  G. Jones said that Susan Yorgensen has been corresponding with him.  K. Metzler said that he would like to schedule a site walk with Susan and Gary.  
The commission discussed what Planning and Zoning are doing about the issue.  

W2003-49 - Notice of Violation: ~Travel Centers of America (the Lessee) and George Giguere ~~of Royce Properties (the Owner) of property located at 327 Ruby Road.

F. Dirrigl discussed the wildlife habitat management plan from FED EX.  He stated that it was a typical wildlife habitat evaluation.  He said that the Army Corp has inspected the area and will prepare a summary.  The next step will be having an outside group come in to provide a study to see if all of the Army Corp goals were met.  
F. Dirrigl stated that according to the report there has been a fall out of reptiles since the 2001 spill.  He stated that a ten-year analysis would need to be conducted in order to see if all wildlife functions have been maintained and what will need to be done if they are not.
